1. Introduction & Acceptance

Welcome to the Deployably.io Early Access Program. By registering for and using the Deployably platform during the Early Access period, you agree to be bound by these Terms and Conditions ("Terms").

Deployably.io ("Deployably", "we", "us", or "our") provides a Platform-as-a-Service for deploying, managing, and monitoring containerized applications. These Terms govern your participation in our Early Access Program and use of all associated services.

2. Early Access Program

The Early Access Program provides access to pre-release features that are still in development. You acknowledge that:

• Features may be incomplete, unstable, or subject to change without notice
• The platform may contain bugs, errors, or security vulnerabilities
• Service availability is not guaranteed
• Data stored during Early Access may be deleted or migrated
• Pricing, feature availability, and quotas may change upon general availability

3. Services Description

Deployably provides the following services during Early Access:

• Deployment Manager: Container deployment, configuration, and lifecycle management
• Image Manager: Container registry integration, image scanning, and metadata management
• Cost Manager: Resource usage tracking, cost analysis, and optimization insights
• Observability Manager: Logs, metrics, traces, and alerting capabilities
• Security Manager: Vulnerability scanning, CVE reporting, and security compliance

4. Account & Access

You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You are responsible for safeguarding any API keys, tokens, or credentials issued to you. Do not share these credentials or embed them in public repositories.

5. Acceptable Use Policy

You agree not to use Deployably to:

• Deploy malware, viruses, or malicious code
• Engage in illegal activities or violate any applicable laws
• Store or transmit content that infringes intellectual property rights
• Conduct cryptomining or resource-intensive operations not related to your legitimate applications
• Launch attacks, scans, or probes against third-party systems
• Circumvent resource quotas, rate limits, or security controls

6. Data & Privacy

We collect account information, deployment data, usage data, observability data, and security data. You retain ownership of your application code, container images, and data. We do not claim ownership of your content.

We retain your data for the duration of your Early Access participation plus a reasonable period thereafter. Upon termination, we will delete your data within 30 days unless legally required to retain it.

7. Security

We implement industry-standard security measures including encryption of data in transit and at rest, role-based access control (RBAC), audit logging, and regular security assessments. You are responsible for the security of your deployed applications.

8. Service Levels

During Early Access, no Service Level Agreement (SLA) is provided. We will make reasonable efforts to maintain platform availability but do not guarantee any specific uptime percentage.

9. Intellectual Property

The Deployably platform is owned by Deployably and protected by intellectual property laws. You receive a limited, non-exclusive license to use the platform during your Early Access participation.

10. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Early Access platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim

11. Termination

Either party may terminate Early Access participation at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to access the platform ceases immediately.

12. Governing Law

These Terms are governed by the laws of Isle of Man, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Isle of Man.
